Terms and Conditions

The terms and conditions for use of the MODERN CAPITAL JEWELLERY TRADING L.L.C's website are detailed below and should be read carefully. We may vary these terms from time to time and therefore you should check them before you make a new transaction.

Definitions

Company: shall be MODERN CAPITAL JEWELLERY TRADING L.L.C

Content: shall mean any text, graphics, images, audio, video, software, data compilations, page layout, underlying source code, and software, as well as any other form of information capable of being stored on a computer and appearing on or forming part of this Website, including any such content uploaded by Customers.

Customer: Any natural or juristic person who enters into a transaction of sale, purchase or storage of a Product(s) with Modern Jewellery.

Customer Service: The service in charge of handling the communication with Customers in relation to Orders, delivery, returns, complaints, claims for defective or damaged Products, and any other post-sale support. Customer Service shall act as the primary point of contact for the resolution of issues arising under the purchase contract but shall not be deemed to confer any rights or obligations beyond those expressly set forth in this terms and conditions or as required by the UAE law.

Order(s): A request submitted by the Customer to the Company via the Website portal for the purchase of Product(s) or Services, which constitutes an offer to enter into a binding contractual relationship upon the company's acceptance.

Order Confirmation: A written or electronic acknowledgment issued by the Company confirming receipt and acceptance of an Order submitted by the Customer. The Order Confirmation signifies the Company's acceptance of the User's offer to purchase the Product(s) and constitutes the formation of a legally binding contract between the Customer and the Company, subject to the terms and conditions set forth herein.

Product(s): each and all products offered on the Company's Website portal.

Eligibility for Use

  • You must be at least eighteen (18) years old to conduct a Transaction with the Company.
  • You must be provide us with the personal identification documents as requested.
  • You must provide us with all of the Details necessary to complete the registration process and any subsequent Transaction.
  • You must ensure that the personal Details provided are complete and correct.
  • You must accept and comply with these terms and conditions.

Order Confirmation and Contract Formation

An Order can be placed via the Website portal.

Prior to confirming an Order, the Customer shall have the opportunity to review and, if necessary, amend the contents of his/her Cart. By clicking the "Confirm Order" button, the Customer submits a binding offer to purchase the selected products or services. Upon receipt of such order, the Company shall issue an automatic confirmation of receipt ("Order Confirmation") via electronic means.

The Order Confirmation shall constitute the Company's formal acceptance of the Customer's offer and shall result in the formation of a legally binding contract between the Customer and the Company.

Following issuance of the Order Confirmation, the Customer shall have no right to cancel or withdraw from the order, unless expressly permitted under applicable consumer protection laws or otherwise agreed in writing by the Company.

The Company reserves the right, at its sole and reasonable discretion, to refuse, cancel, or terminate any order prior to delivery, including but not limited to circumstances involving full or partial non-payment by the Customer. Such refusal, cancellation, or termination may be effected without incurring any liability towards the Customer.

Shipping, Delivery, and Transfer of Risk

All Products shipped by the Company shall be insured during transit. The risk of loss or damage to the Products shall transfer to the Customer immediately upon completion of delivery.

Where the Customer selects the shipping option, delivery shall be deemed to have occurred at the moment the Product(s) are handed over at the agreed delivery address or designated pick-up location to an individual who identifies or claims to be authorized to accept delivery. The Company reserves the right to request proof of identity from the receiving party.

Delivery shall be considered complete upon such handover, and the Company shall bear no responsibility for any loss, damage, or misdelivery thereafter.

In the event that the Company, due to circumstances beyond its reasonable control, is unable to complete delivery of the Product(s), it reserves the right to cancel the relevant portion of the contract. In such cases, any payments received in respect of the undelivered Product(s) shall be refunded to the Customer. This shall be without prejudice to the Company's right to recover any additional costs or expenses incurred.

The Customer acknowledges and accepts that the delivery of Product(s) may be subject to applicable customs duties, import taxes, or other governmental charges, which shall be borne solely by the Customer.

In the event of a disruption, delay, or damage during the shipping process, the Customer agrees to cooperate fully with the Company and any relevant third parties in the investigation and claims process, including but not limited to, providing requested documentation or statements. Failure to provide such cooperation may result in the forfeiture of any insurance coverage or claim-related remedies otherwise available to the Customer.

Where a delivery attempt is unsuccessful due to reasons attributable to the Customer, including but not limited to, unavailability at the designated address or failure to provide adequate delivery instructions, any costs associated with re-delivery shall be borne by the Customer.

Delivery timelines are indicated at checkout for the Customer's reference. As a general guideline, delivery to UAE city addresses is expected to take approximately 2 to 3 working days, subject to courier availability and any unforeseen delays.

Where the Customer selects the office collection option, no additional delivery or handling fees shall apply. The Customer shall be required to present valid government-issued identification (ID) at the time of collection. The Company reserves the right to refuse release of the Product(s) in the absence of adequate identification.

The Company offers a buyback service whereby Customers may sell Product(s) back to the Company, provided that such items remain in their original, untampered packaging. Customers must contact the Company to initiate the buyback process. Upon inspection and confirmation of eligibility, the Company will issue a price quotation. If accepted, the Company will arrange for collection and inspection of the items. Once the inspection is successfully completed and both parties agree on the final terms, payment shall be settled via bank transfer to the Customer.

5. Product Faults and Limitation of Liability

In the event of any defects or non-conformities in the Products that are not apparent at the time of delivery and signature, the Customer shall notify the Customer Service in writing within three (3) calendar days from the date of receipt of the Products. Failure to provide such notice within the specified period shall constitute deemed acceptance of the Products in their delivered condition.

In cases where multiple Products are purchased under a single Order, any defect, replacement, or failure to deliver one or more individual Products shall not affect the validity or enforceability of the remainder of the purchase agreement.

Upon timely receipt of a valid claim and subject to verification and acceptance of the reported defect by the Company, the Company shall, at its sole discretion, either (i) replace the defective Product(s) at its own cost, or (ii) issue a refund to the Customer in respect of the affected Product(s).

Except as expressly provided herein, the Company shall have no further liability or obligation towards the Customer in relation to any such defect, loss, or damage.

Intellectual Property

All content included on this Website is the exclusive property of the Company or its licensors and is protected by the UAE copyright, trademark, database, and other intellectual property laws.

By accessing and continuing to use this Website, the Customer acknowledges and agrees that all such Content is the intellectual property of Modern Jewellery or its relevant licensors and is protected accordingly.

Nothing contained on this Website shall be construed as granting, whether expressly, by implication, estoppel, or otherwise, any license or right to use any trademark, logo, service mark, or other intellectual property displayed on the Website without the prior written consent of the rightful owner.

The Customer shall not reproduce, modify, copy, distribute, transmit, display, perform, publish, license, create derivative works from, transfer, or otherwise use any Content on this Website for commercial purposes without the prior written authorization of the Company.

Returns and Exchanges

Following delivery, no return or exchange of Products shall be permitted unless expressly authorized in writing by the Company. Any such authorization shall be granted at the sole discretion of the Company and may be subject to additional conditions.

In the event that the Company consents to a return or exchange, the Customer must complete the return shipment within two (2) calendar days from the date on which the Company provides written confirmation of its acceptance. Any return initiated or received after the expiration of this period shall be automatically refused, and no refund or exchange shall be processed.

All returned Products must be in their original condition and packaging (with original certificates if applicable), and must be shipped with a delivery method that requires a signature upon receipt.

The Customer shall bear full responsibility for the risk of loss or damage to the Products during the return shipment and shall be solely liable for all shipping fees, customs duties, insurance costs, or other charges incurred in connection with the return, unless otherwise expressly agreed in writing by the Company.

Indemnification

The Customer agrees to indemnify, defend, and hold harmless the Company, its affiliates, shareholders, officers, directors, employees, agents, and suppliers from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:

  • (a) the Customer's access to or use of the services;
  • (b) any breach by the User of these Terms and Conditions; or
  • (c) any violation by the Customer of any third party rights, including. but not limited to intellectual property rights or other proprietary rights, etc.

Entire Agreement

These Terms and Conditions constitute the entire agreement between the Company and the Customer with respect to the subject matter herein and supersede all prior and contemporaneous understandings, agreements, negotiations, representations, warranties, proposals, correspondence, or other communications, whether oral or written, relating to such subject matter.

No modification, amendment, or waiver of any provision of these Terms and Conditions shall be valid unless made in writing and duly executed by both parties.

Governing Law and Dispute Resolution

By accessing, browsing, or using this Website, or by placing any Order through it, the Customer expressly agrees to be bound by these Terms and Conditions, which shall prevail over any other terms or conditions, whether communicated orally or in writing, unless expressly agreed otherwise in writing by the Company.

Any agreement or contract entered into between the Customer and the Company through the use of this Website shall be governed by and construed in accordance with the laws of the United Arab Emirates.

In the event of any dispute arising out of or in connection with the use of this Website, or any such agreement or contract formed, and where such dispute cannot be resolved amicably, the parties agree to submit to the exclusive jurisdiction of the competent courts of Dubai, United Arab Emirates.
